This already happened glancingly with the MySQL AB case and the
netfilter cases of (if memory serves) last year.  However, it's simply
not been necessary, those cases or others, to fully adjudicate the
theoretical questions of interest to open-source / free-software people:
Judges tend to ignore theoretical questions.
